TOWN OF TAYLORSVILLE, NORTH CAROLINA

WATER CONSERVATION ORDINANCE

 

Section 1. Purpose.

The purpose of this Ordinance is to establish procedures for the conservation of water by utility customer of the Town of Taylorsville during times of drought and other natural or man-made events that negatively impact the Town's water supply.

 

Section 2. Violations; penalties
A person who knowingly or intentionally violates or causes. the violatio!1 of" any restriction or prohibition on the use of water or related activities contained in the following stages of water conservation orders shall be p\1nishcd as shown for each stage:
 
Stage I (Voluntary Conservation). No penalty.
 
Stage II (Mandatory Conservation). Warning for first violation; $100 fine for second violation; additional $200 fine for each violation over three.
 
Stage III (Emergency Restrictions) - $100 fine for first violation; $200 fine for second violation; additional $300 fine for each violation over three.
 
Stage IV (Water Rationing) - $300 fine for first violation; $400 fine for second violation; additional $5OO for each violation over three.
 
Section 3. Stage I (Voluntary Conservation)
The Mayor or Town Manager is authorized to implement Stage I (Voluntary Conservation) when the Town's water supply situation deems necessary. The Mayor or Town Manager is further authorized to terminate Stage I (Voluntary Conservation) based upon a change in the Town's water supply situation. The order to implement or to terminate Stage I (Voluntary Conservation) shall be made by public announcement, shall be published at least one time in a newspaper of general circulation in the Town, and shall be forwarded to each member of the Town Board of Commissioners.
 
The order of the Mayor or Town Manager under this Section shall:
 
  (a) Issue a water shortage advisory to the public.
  (b) Inform the public of the potential water shortage.
  (c) Request customers to practice voluntary water conservation.
 
Section 4. Stage II (Mandatory Conservation)

The Mayor or Town Manager is authorized to implement Stage II (Mandatory Conservation) when the Town's water supply situation deems necessary. The Mayor or Town Manager is further authorized to terminate Stage II (Mandatory Conservation) based upon a change in the Town's water supply situation. The order to implement or to terminate Stage I (Voluntary Conservation) shall be made by public announcement, shall be published at least one time in a newspaper of general circulation in the Town, and shall be forwarded to each member of the Town Board of Commissioners.
 

The order of the Mayor or Town Manager under this Section shall:
  (a) Issue a water shortage alert to the public
  (b) Inform the public of the water shortage.
  (c) Establish water conservation goals.
  (d) Ban all non-essential water use, including;
    (1)

Watering of lawns, shrubs, trees, ornamental plants. etc. expect by use of hand held containers, including a watering can or bucket

    (2) Washing of outside areas such as driveways, carports, outbuildings, etc.
    (3) Residential washing of vehicles including RVs and ATVs.
    (4) Filling of pools of any size or type, including "kiddie" pools.
    (5) Operation of ornamental pools, ponds, or fountains
    (6) Taking water from a hydrant for any reason other than fire protection.
  (e) Assist commercial and industrial users in identifying methods to conserve as much water as possible.
  (f) Requite any bulk water customers to implement mandatory water conservation policies.
 
Section 5. Stage III (Emergency Restrictions)
The Mayor or Town Manager is authorized to implement Stage III (Emergency Restrictions) when the Town's water supply situation deems necessary. The Mayor or Town Manager is further authorized to terminate Stage III (Emergency Restrictions) based upon a change in the Town's water supply situation. The order to implement or to terminate Stage I (Voluntary Conservation) shall be made by public announcement, shall be published at least one time in a newspaper of general circulation in the Town, and shall be forwarded to each member of the Town Board of Commissioners.
 
The order of the Mayor or Town Manager under this Section shall:
 
  (a) Issue water shortage emergency statement to the public.
  (b) Inform the public of a water emergency.
  (c) Set aggressive water conservation goals.
  (d) Ban all non-essential water use as defined in Section 4.
  (e) Monitor all water related activities, especially with compliance and bans.
  (f)  Require all commercial and industrial users to identify methods to conserve as much water as possible.
  (g) Require all bulk water customers to implement emergency water restrictions.
 
Section 6. Stage IV (Water Rationing)
The Mayor or Town Manager is authorized to implement Stage IV (Water Rationing) when the Town's water supply situation deems necessary. The Mayor or Town Manager is further authorized to terminate Stage IV (Water Rationing) based upon a change in the Town's water supply situation. The order to implement or to terminate Stage I (Voluntary Conservation) shall be made by public announcement, shall be published at least one time in a newspaper of general circulation in the Town, and shall be forwarded to each member of the Town Board of Commissioners.
 
The order of the Mayor or Town Manager under this Section shall:
 
  (a) Alert the public of water rationing.
  (b) Inform the public of a state of water emergency.
  (c) Ban all non-essential water use as defined in Section 4.
  (d) Begin mandatory allocation of water, which may include temporary disconnection of water to non-residential users.
  (e) Immediately reduce water usage by at least 25 percent
  (f)  Requite all bulk water customers to implement water rationing policies.
 
Section 7. Enforcement
All elected officials and departments of the Town shall monitor and report all violations of this Ordinance to the Town Manager or Director of Public Works. The Town Manager or Director of Public Work shall enforce penalties as defined in Section 2 of this Ordinance.
 
Section 8. Adoption
This Ordinance adopted the 16th day of August, 2002. By a vote of 3 in favor (Phillips, Robinette, Holleman) and 0 opposed.
